Myth
All mediation
processes are
the same
FALSE
There are various kinds of media琀椀on processes
including family and workplace dispute
resolu琀椀on processes, that di昀昀er from one
another. Family media琀椀on supports people to
plan their paren琀椀ng and property arrangements
following a rela琀椀onship separa琀椀on. Registered
Family Dispute Resolu琀椀on Prac琀椀琀椀oners (FDRPs)
are accredited with the A琀琀orney General’s
Department, under the standards set out in
the Family Law (Family Dispute Resolu琀椀on
Prac琀椀琀椀oners Regula琀椀ons) 2008. FDRPs
have exper琀椀se in guiding par琀椀es through a
prescribed family dispute resolu琀椀on process
under the Family Law Act 1975 (Cth).
At the end of the media琀椀on process, separa琀椀ng
par琀椀es’ may dra昀琀 a paren琀椀ng plan and/or a
mediated agreement regarding their property.
In contrast, the Australian Na琀椀onal Mediator
Standards apply to mediators accredited
under the Na琀椀onal Mediator Accredita琀椀on
System (NMAS). Mediators accredited under
NMAS can conduct media琀椀ons rela琀椀ng to
workplace, community, corporate and other
issues and these media琀椀ons are not governed
by the Family Law Act 1975 (Cth), therefore,
making the process a li琀琀le di昀昀erent. There are
commonali琀椀es and core structures across all
media琀椀on processes, however, and mediators
are registered with their appropriate registra琀椀on
body to conduct media琀椀ons.
